Last updated: December 6, 2024
Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://www.cafsbenefits.net website (the “Service”) operated by California Association of Family Services (“CAFS”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you should not use the Service.
1. Eligibility and Membership
You must be at least 18 years old to use this Service. By signing up, you confirm that the information you provide is accurate and complete. You agree to keep your account information current.
Membership with CAFS includes access to discounted professional services provided by a network of third-party providers, including attorneys, notaries, and financial professionals. These providers are not employees or agents of CAFS.
2. No Legal Advice
CAFS is not a law firm and does not provide legal advice.
Any legal services offered through the Service are provided exclusively by independent licensed attorneys, not by CAFS. Any information provided on our website, in webinars, or by our staff is for general informational purposes only and should not be considered legal, financial, or tax advice.
If you choose to work with an attorney or other professional through our network, your legal relationship is strictly with that provider.
3. Purchases and Billing
By purchasing a membership or service through the Service, you agree to provide accurate billing information including a valid credit card number, expiration date, billing address, and other relevant details.
We use secure third-party payment processors. By submitting your payment information, you authorize us to share that information with these third parties subject to our [Privacy Policy].
We reserve the right to cancel any order or membership for reasons including but not limited to errors in pricing or availability, suspected fraud, or violation of our Terms.
4. Refund Policy
All membership fees and service fees are non-refundable unless otherwise stated in writing at the time of purchase. CAFS may, at its sole discretion, grant refunds under certain circumstances as a courtesy, not as an obligation.
Please review your membership package and ask any questions before finalizing your purchase.
5. Third-Party Providers
CAFS partners with independent professionals to deliver services to members. We do not supervise, direct, or control the work of any third-party provider.
We are not liable for any act or omission of a third-party provider, and we make no warranties or guarantees regarding the outcome of services you may receive from them.
You are responsible for evaluating and selecting any professional you work with, and you may decline to use any provider referred by CAFS.
6. Intellectual Property
All content, branding, materials, and design elements on the Service are the property of CAFS or its licensors and are protected under copyright, trademark, and other applicable laws.
You may not copy, reproduce, or use our intellectual property without our express written permission.
7. Termination
We may suspend or terminate your access to the Service and your membership at any time if you breach these Terms or engage in conduct harmful to CAFS, our members, or our providers.
You may cancel your membership at any time by contacting us. Cancellation does not entitle you to a refund unless explicitly offered in writing.
8. Limitation of Liability
To the fullest extent permitted by law, CAFS shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service or your interactions with any third-party provider, even if advised of the possibility of such damages.
We do not guarantee that the Service will be available uninterrupted, error-free, or free of viruses.
9. Indemnification
You agree to indemnify, defend, and hold harmless CAFS, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising out of your use of the Service, your violation of these Terms, or your dealings with any third-party provider.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. You agree to resolve any dispute with CAFS through good-faith negotiation, and if necessary, through binding arbitration in California.
11. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the website or email. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
